Part 215 Amendments passed by the House/Senate and signed by the Governor on July 20, 2006:
Part 215 of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended, provides for a 7/8 cent per gallon fee on refined petroleum.
Section
21506a(4)
of Part 215 details where the monies can be expended. The Refined Petroleum Cleanup Advisory Council (Advisory Council) was created on October 12, 2004 under Section 21552 of Part 215. The Advisory Council has made
recommendations
on June 7, 2005 to the Governor and the Legislature on how $60 million, transferred into the RPF from the former MUSTFA program, should be spent. On March 21, 2006, the Advisory Council provided a letter of support for the draft legislation which authorized the use of $15 million
for an initial Refined Petroleum Product Cleanup Program and $45 million for a Temporary Reimbursement Program. The legislation was signed by the Governor and filed with the Secretary of State July 20, 2006, with immediate effect.
